PROCEDURE FOR PROCESSING COMPLAINTS REGARDING REGISTRATION ISSUES

 This document describes the process that ISPE will follow to disposition complaints that are received regarding registration issues.  Generally, these involve questioning or reporting an individual who is allegedly practicing engineering without a license, etc.  The process to be followed is as follows:

  1. Complaints received by the ISPE should be forwarded to the Executive Director so that a record of their occurrence and disposition can be maintained.

  2. The Executive Director will assemble the available information provided by the complainant, and forward it via email concurrently to the ISPE President and the Chairperson of the Registration Committee.

  3. The Registration Committee will be responsible for recommending whether a formal complaint should be forwarded to the Illinois Department of Financial and Professional Regulation (IDFPR).

  4. To accomplish this process, the Committee chair will forward the information to the Committee members via email and solicit their comments and their opinion regarding whether ISPE should lodge a formal complaint.

  5. The Chair may convene a conference call if special circumstances warrant.

  6. The Committee shall form their comments and opinions based primarily on the information provided, and shall not themselves independently initiate contact with either the complainant or the person whose activities are the subject of the inquiry.  The Committee and ISPE have no authority to investigate complaints.  However, if members feel that the complainant should be contacted regarding specific questions, then such a request should be included in comments to the Chair.  The Chair may contact the complainant if considered appropriate.

  7. The Chair will review and summarize the comments and opinions, and forward a consensus position jointly to the ISPE President and the Executive Director via email.  Position statements may include recommendations that include education, dialog, etc.  A copy of the collective response from the Chair will be forwarded concurrently to the Committee members.  If there is a lack of consensus, then the President will make the decision. 

  8. The subject of any potential complaint actions is recognized to be sensitive information and should be treated accordingly.

  9. If recommended by the Committee, the Executive Director will file a formal complaint with IDFPR on behalf of ISPE.  Regardless, the Executive Director will also inform the complainant of the ISPE position.

  10. The Executive Director will monitor the disposition of any complaints with IDFPR, and provide such information to the ISPE President and the Registration Committee.
